- Joselito Cayetano was disqualified as a nuisance candidate by the COMELEC 1st Division.
- Joselito Cayetano was called a nuisance candidate because it is clear that he does not have any capacity to conduct a nationwide campaign. The 1st Division took into consideration Joselito Cayetano’s financial circumstances and the fact that he was relying almost exclusively on KBL – the political party which allegedly nominated him, but whose top leadership has recently ‘disowned’ him.
- Joselito Cayetano may still appeal the ruling of the Division, thus the disqualification still is not final.
- In the meantime, considering that the disqualification may still be overturned on reconsideration, Mr. Joselito Cayetano’s name will remain on the Certified List of Candidates for Senators (for the 2007 National and Local Elections).

Fearing a third impeachment complaint filed against President Arroyo in the new House of Representatives will finally do her in, Malacañang’s Office of External Affairs (OEA) Assistant Secretary Marcelo Fariñas and President Arroyo had already hatched as early as October last year a plot to minimize, if not totally eliminate the number of leftist and anti-Gloria party-list groups while providing full support and funding for Commission on Elections (Conelec)-accredited party-list groups that are “ascertained to be pro-administration” and ensure the victory of at least 12 pro-Arroyo party-listers while working to have a 40 pro-Arroyo party-list member bloc in the next Congress.
The plot also called for the formation of a pro-Arroyo party-list bloc that will support the plans and programs of Mrs. Arroyo and “help in countering destabilization moves by the opposition, as well as the left-leaning party-list groups.”
The plan also hinted at engaging in poll fraud again, as it spoke of the need to “contribute in the overall campaign to substantially lower the number of votes of leftist and left-leaning party-list organizations and in the process, reduce the seats of these anti-administration parties in the House of Representatives.”
Left-leaning party-list organizations were able to secure a document proving their claim that Malacañang is funding the candidacy of the alleged “frontline organizations” of the Arroyo government aimed at thwarting any attempt to
impeach the President during the next Congress.
Gabriela Rep. Liza Masa said she and her group were able obtain the “confidential” memorandum of assistant secretary Fariñas, head of the Office of External Affairs special concerns group of the office of the President, to lawyer Erlyn de Leon, special assistant to the President and close confidante. The memo sought Palace funding for these party list groups that would be supported by the Palace.
“These well funded party list organizations shall actively campaign for 40 seats in Congress with the foremost objective of gathering additional votes in the House of Representatives for another round of impeachment against the President,” the memorandum dated Oct.16, 2006 said.
The OEA proposal further said that the administration and its allied civil society organizations should have a comprehensive counter-plan with the objective of frustrating this “grand plan” of the Left and the opposition.
The same plan also mentioned the easing out of known opposition party list groups that are also aiming to get seats through the party list system. Mentioned were the United Opposition group as well as other organizations that are identified with detained President Joseph Estrada, such as MARE, PMAP, UMDJP and others.
It has been noted that the Comelec had for the most part, disqualified many of these groups known to be anti- administration, while allowing unheard of party list groups to be fully accredited and refusing to make their nominees public.
Reliable sources in the opposition camp told the Tribune that this disqualification of these opposition party list groups was also part of the Palace plan that had the active participation of the Comelec.
From October to December 2006, Farinas asked for a P5.5 million budget to cover just the firming up of the party list, operationalization of the headquarters and the planning and consolidation of the network and party list conventions.
In the memorandum, written on the stationery of the Office of the President, it was also stated that the groups that would be enjoying the support of the government are Agbiag! Timpuyog Ilocano (AGbiag), Babae para sa Kaunlaran (Babae ka), League of Youth for Peace and Development (Lypad) and Kalahi Advocates for Overseas Filipinos (Kalahi).
“Two to five more party list groups shall be given support, which may include a coalition of Muslim and Indigenous Peoples and already registered party list parties,” the memorandum reads.
In the memorandum, Fariñas requested for funding for the SGC, as well as the various party list groups identified as pro-administration. The funds, according to the memorandum, would be sourced from the President’s intelligence fund.
In a separate interview with poll Commissioner Rene Sarmiento, he claimed he had never heard of this issue, but said he would be bringing this up to the Commission en banc since he said this was a very “serious” matter that concerns national interest.
“This is the first time I came to know of this memorandum, so what I’ll do is to bring this to the attention of the commission en banc because this is serious and I think my fellow commissioners should learn about this because this has an impact on the party-list system of election,” he said.
He also noted that they are waiting for the results of the investigation conducted by the law department on the allegations that some Comelec personnel are involved in the selling of the accreditation of the party list groups. Earlier reports pointed to unnamed Comelec commissioners as being behind the sale.
Rafael Mariano of Anakpawis pointed out that the use of the President’s intelligence fund to support party list groups in the coming May 14 elections is alarming as it shows how intensely the desire of the government is to win more seats in Congress.
“GMA fears impeachment. This is why she is meddling in the party list elections,” he told reporters.
It will be recalled that Rep. Loretta Ann Rosales of Akabayan asked the Comelec to disqualify 11 party list groups believed to be backed and funded by the government.
According to Rosales, these party list groups are Babae Ka, Ang Kasangga, Akbay Pinoy, Aksyon Sambayanan (Aksa), Agbiag!, Ahon Pinoy, Aangat Tayo, Aangat ang Kabuhayan (Anak), Alliance for Nationalism and Democracy (Anad), Kakusa and Biyaheng Pinoy, which has Dr. Arsenio Abalos, elder brother of Comelec chairman Benjamin Abalos, as its first nominee.
Gabriela’s Liza Maza yesterday bared Malacañang’s grand plan to prevent progressive and opposition partylist groups from winning during next month’s election.
Maza pointed to the Palace’s OEA group as being behind the “dirty tricks” against opposition and progressive partylist groups.
“There is a grand scheme to prevent our party list from winning and/or adding more seats for the pro-Gloria group in Congress and Malacañang’s dirty hands are behind it. This is the biggest travesty of the partylist system,” Maza said yesterday in a press conference.
Maza, armed with a copy of a confidential memorandum asking Mrs. Arroyo’s approval to fund the scheme against Gabriela, Bayan Muna, Anakpawis, Kabataan, Suara Bangsamoro and other partylist groups, said the objective of the campaign was to ensure the victory of pro-administration party lists and to reduce the number of opposition and left leaning party list groups.
“This scheme therefore complements the disqualification case against our parties and the killings and harassment of our members and supporters. The tragedy of this all is that not only is this scheme out to shove us out of Congress but it is robbing the underprivileged Filipinos of their right to be represented as enshrined in the party list system,” said. Maza.
The OEA memorandum said that, “this specific electoral campaign has the following objectives:
Provide full support to several Comelec-accredited that are ascertained to be pro-administration and ensure the winning of seevral seats in the House; the formation of a party list bloc supporting Mrs. Arroyo and help in countering moves to destabilize her and contribute in the over-all campaign to substantially lower the number of votes of leftist and left-leaning partylist organizations and in the process reduce the seats of these anti-administration parties in the House of Representatives.”
Fariñas, in his memo for Mrs. Arroyo said that they have already secured an office at the Ortigas Avenue in Greenhills as its operations center and that there is a need to get more people to ensure the objectives of the plan.
Farinas, in the same memorandum, also said that his group has a national and international network of support groups from places such as the United States, Middle East, Asia Pacific and ethnic groups in the country.
Farinas said they would need P5.5 million to fund the project from October to December 2006.
“Corollary, may we request that funding assistance from Her Excellency’s intelligence funds be immediately granted to the SCG as well as the various partylist groups identified as pro-administration,” Fariñas said in his memorandum.
Farinas was requesting funding support for the said special concerns group which will run these parties.
“The registration and entry of these partylists in this elections, with funding and support from Malacanang, grossly violates the provisions of the Party List Law and the Constitution,” said Maza.
The Gabriela solon urged that investigations be conducted on pro-administration candidates and on the OEA.
Mrs. Arroyo appears to have also been in on the military’s move to deploy troops in Metro Manila to intidimate, harass, coerce and threaten the supporters of the militant groups and having the voters reject these groups.
